Expressed purpose is not in the consensus rules. The code allowed witness data. People used it. That's how permissionless works.
Your 'financial vs non-financial' line requires someone to judge every transaction's intent. Who decides? At what block height does a JPEG become financial enough to count? The timestamp doesn't eliminate the governance layer, it just pretends the decision was already made.
Lightning wasn't explicitly designed for submarine swaps or LSPs either. Calling unintended use an exploit means Bitcoin can only be used for things Satoshi wrote down. That's not a protocol, it's a museum.
