Not sure about the US, but in many countries the government can prosecute a crime even if nobody presses charges. So indeed they'd have to reframe their action as some sort of responsible disclosure ("we took it because someone else would have"). Offering to keep half wouldn't be a good look.

I guess they could frame the lack of early public announcement as an opsec thing.
