"Too encrypt is to indicate the desire for privacy, to encrypt with weak cryptography is to indicate not too much desire for privacy" in my opinion, it is good faith to ignore private key leaks, or let the keyholder know if possible. However, good faith cannot be assumed.

The core issue isn’t access, but the fundamental asymmetry of cryptographic keys – a single vulnerability creates infinite potential exploitation.

Silly question. It will depend on how they were exposed, but in most cases the blame is not one-sided. Enough blame to go around for both sides.
