Cool that you are working in a requirement list before submitting. I do not agree with it's the users responsibility to check. It's the stores responsibility to check before they publish other's apps ...
It's an impossible problem. If I check and remove apps I will be called a censor. So this is the tradeoff we chose: users responsibility.
