If you search for that term and "ソフトウェア使用許諾契約" (EULA) on Google, you get only a few pages of hits, with Cubism near the top and most of the others reasonable usage (things like "don't create a spin-off Synth V voicebank").

So yeah this is Not Normal in EULAs.

Now here's a fun fact: 派生作品 is a term for "derivative work" (in legal copyright terms).... in Chinese.

(The strict legal term is 演绎作品 but I'm told 派生作品 is common in Chinese license agreements).

So my guess is either:

1) A Chinese native wrote the Live2D EULA for some reason, and messed this (and more) up; or
2) The Japanese person who wrote this knew there's zero chance the legal "derivative work" idea would fly and tried to make up a term and word for something else.

Or they simply had someone with no legal copyright experience write this up.

Either way, this entire EULA is incredibly amateurish, and large portions are likely unenforceable.

Ah wait. I see what happened here. All this wording is included, verbatim, in the *SDK* EULA. Now of course, a program you create with the SDK *is* a derivative work of the SDK. So... yet another copypasta error, this time from Japanese to Japanese! Live2D are clearly a *very* professional team.
