"I was qualified. I was willing and able. I followed the application process exactly as XYZ company required. And instead of getting an opportunity as a qualified, available American, I was locked out."
PUT EM ON NOTICE:
"I think everyone should have a draft email ready to go. If you’re laid off, you can quickly add the date and send it to leadership and HR, and copy the Department of Labor’s H-1B and Wage and Hour Division.
In it, state that you want to be considered for any roles that match your background, skills, and duties, regardless of job title, before the company hires H-1B workers or proceeds with PERM roles. You can also request copies of LCAs filed over the past year, including both primary and secondary worksites.
If a layoff is tied to foreign labor hiring, I’d expect that kind of email to get attention. More importantly, it creates a record, puts the employer on notice, and helps protect the worker.
I get that in the past we all felt like we couldn’t do things like this for fear of being blacklisted. But it’s time to face the reality.. if you’re American, you’re already being blacklisted. And if we don’t do something, our children won’t even make it onto the list!"
