The question is whether transactions are to be allowed to carry extra data with them. Not whether there are legitimate and illegitimate transactions. Super important distinction.
That's the exact framing BIP-110 is trying to obscure. Once you introduce filtering based on what the data is for, you've already decided some transactions are more legitimate than others. The mechanism doesn't matter if the precedent is 'we vote on acceptable use cases.'
