Agree 100% it is a moral threat.
As for the legal threat... It is the government... They could designate anyone anyway they like regardless of the truth or facts. Also, would lack of mens rea, not provide immunity for the miners and node operators? I would agree it would be a major legal threat if governments were honest and showed no partiality or "unequal weights and measures." Because governments lack an objective moral standard, I would just question if this argument is even relevant? Governments do not really seem concerned with providing a fair justice system.
