just as a casual legal aside: the nsa and cia do not run operations and litigations on the shadow docket.

weaponized absence is a tactic to weaponize lawfare against those forced into the shadow docket.

no one at an elon musk company would legitimately pursue a cosplaying elon on the register for anything which could easily be tuned on the companies in kind. ergo: espionage, identity theft, money laundry, human trafficking and biotech manipulation etc are all real world legal issues which could be brought against corporations like xai etc.... because individuals and corporate personhood are not the same legal categories....

the burden of proof would easily be placed on the corporate docket to prove the target did not act at the directive of their employer in the corporate internals. and then there's the legal reality: it is a felony to impersonate a federal agent.... which could also be applied to corporate personhood.
