It's true, bip110's rules were still accepted by all other nodes.
In practice if you run bip110 you do not accept many transactions, but if you run normal nodes you still accept bip110 valid transactions.
Bip110 forked voluntarily and it doesn't seem to have stopped spam in any other way than moving to a chain that doesn't produce blocks.
Also changing pow algorithm seems so dangerous by itself, not counting the top-to-bottom decision.
Just my opinion, i can be wrong, time will tell.
