The first statement is wrong. It only took less than 1% of the notes to propagate a transaction with a different default setting like OP_Return size. This can be proven. More nodes just increase the propagation speed. Not to mention that you can send transactions directly to miners or mine yourself.

That’s why the default was removed! Not to mention that we have seen many transactions with higher OP_Return long before the change
