وقال ابن الحاج المالكي المتوفى سنة "٧٣٨هـ" بعد ذكره لكثير من المفاسد التي أحدثها الناس لما عملوا المولد في كتابه: المدخل: فصل في المولد ١/٢٣٤،٢٣٥:"وهذه المفاسد مركبة على فعل المولد إذا عمل بالسماع، فإن خلا منه وعمل طعامًا فقط ونوى به المولد ودعا إليه الإخوان وسلم من كل ما تقدم ذكره فهو بدعة بنفس نيته فقط، إذ إن ذلك زيادة في الدين وليس من عمل السلف الماضين، واتباع السلف أولى، بل أوجب من أن يزيد نية مخالفة لما كانوا عليه؛ لأنهم أشد الناس اتباعًا لسنة رسول الله ﷺ وتعظيمًا له ولسنته ﷺ، ولهم قدم السبق في المبادرة إلى ذلك. ولم ينقل عن أحد منهم أنه نوى المولد، ونحن لهم تبع فيسعنا ما وسعهم".
وقال شيخ الإسلام ابن تيمية كما في مجموع الفتاوى ٢٥/٢٩٨:"أما اتخاذ موسم غير المواسم الشرعية، كبعض ليالي شهر ربيع الأول التي يقال: إنها ليلة المولد، أو بعض ليالي رجب، أو ثامن عشر ذي الحجة، أو أول جمعة من رجب، أو ثامن شوال – الذي يسميه الجهال: عيد الأبرار – فإنها من البدع التي لم يستحبها السلف، ولم يفعلوها".
وقال الحافظ ابن حجر الهيثمي المصري الشافعي – وهو ممن لا يرى تحريم عمل المولد "نقلًا عن حسن المقصد للسيوطي" ١/١٩٦ قال:"أصل عمل المولد بدعة لم تنقل عن السلف الصالح من القرون الثلاثة".
وقال الشيخ محمد بن عبد السلام الشقيري المصري في السنن والمبتدعات ص١٣٩: "اتخاذ مولده موسمًا والاحتفال به بدعة منكرة ضلالة، لم يرد بها شرع ولا عقل، ولو كان في هذا خير فكيف يغفل عنه أبو بكر وعمر وعثمان وعلي وسائر الصحابة والتابعين وتابعيهم والأئمة وأتباعهم، لا شك أنه ما أحدثه إلا المتصوفون الأكالون أصحاب البدع،

2. Brotherhood is not mankind / not goyim
The sermon’s “every Muslim is a brother…” is a cross-tribal religious umma.

The parallel rabbinic slogan is the opposite scope:

“All Israel are responsible for one another” (Sifra on Lev 26:37; later cited as Sanhedrin 27b / Shevuot 39a in corpus commentary).
That is Israel for Israel, not Jew-for-gentile and not human-for-human as one polity.
Negatively: the Talmud does not teach that Jews and goyim form one brotherhood that forbids taking each other’s property as co-religionists. Mutual surety is in-group.

3. Law does encode unequal treatment of the gentile (not “except by piety”)
Local Bavli:

Bava Kamma 37b:12 (English, merged): ox of a Jew that gores ox of a gentile → owner exempt; ox of a gentile that gores ox of a Jew → full damages, whether tam or mu’ad.

That is not “no superiority.” It is asymmetric civil liability by identity. Later readers (e.g. Meiri) try to fence this to “nations without Noahide ethics,” but the sugya as indexed still shows the default Talmudic text is not the Farewell Sermon’s parity.

Negatively: regarding goyim, the Talmud disagrees with “no group superiority in rights.”

4. “You are called adam” — language that excludes gentiles from a human legal category
Local Bavli:

Yevamot 61a:1 / Bava Metzia 114b:2 (English, merged): from Ezek 34:31, “you… are man [adam]” → Jews are called adam; gentiles are not called adam for the law of corpse-impurity in a tent (Num 19:14). Gentile graves do not render impure via tent.

Even if the halakhic point is purity, not ontology, the midrashic wording is exclusionary: gentiles fail a scriptural label “man” in this rule.

Tosafot on Yevamot 61a (commentary) already struggle with other verses where adam includes gentiles — which shows the exclusionary reading is sharp enough that later authorities had to limit it. The negative fact remains: the Bavli can and does say gentiles are not called adam here. That is not the sermon’s universal anthropology.
5. Gentile Torah is not open brotherhood knowledge
Sanhedrin 59a:3 (English, merged): a gentile who studies Torah is treated, on one view, as robbing Israel of its inheritance; on another, like one who violates a betrothed woman (capital imagery).

Negatively: the Talmud does not welcome the gentile into equal sacred study as a brother in one faith-community. Access is contested and often hostile, not “one brotherhood under piety.”

(Other sugyot praise limited gentile engagement with Torah; that does not erase this negative line — it proves internal conflict, not agreement with the sermon.)

6. One Adam is not the same as equal peoples
Sanhedrin 37a:14 (English, merged) and Mishnah Sanhedrin 4:5-type reasons:

One ancestor so no one says “my father is greater than yours”
Peace among people; uniqueness of faces
Negatively reframed: this blocks lineage bragging inside a shared human origin story. It does not abolish:

Israel vs. the nations
differential damages
differential impurity midrash
Israel-only mutual responsibility
Torah-as-betrothed / inheritance rhetoric against gentile study
So “all from Adam” in the Talmud is compatible with (and in practice sits beside) structural inequality toward goyim. It is not the Farewell Sermon’s package.

Yerushalmi Sanhedrin 4:9:3 even uses single creation against genetic moral caste — still not equal legal-religious status for gentiles.
