It's a weird extraction loophole, so Delta 9 is the psychoactive part of THC. And if you got it from a regular marijuana plant, it was illegal and classified as regular marijuana. But if you extracted it from legal hemp, which had an extremely low THC count, it was legal.

Like if you're a lab and you're doing legal hemp extraction for CBD, you still get trace amounts of Delta 9 and other cannabinoids. But if you're processing literal metric tons of hemp, you're still going to end up with kilos of delta-9, which, based on current laws, would make it federally legal, psychoactive cannabis.
