The gun was bolstered on his back side, he never reached for it in the scuffle. The agent disarmed him right in view of the agent who shot him after he was disarmed. He wasn't assaulting officers, he was filming and then tried to help up another person who was pushed to the ground when he was pulled back into the street by the agent and pushed to the ground where he remained in fetal position, defending himself from punches being thrown by a mob of agents.
