I looked it up. The issuance of BIP110 is closer to that of BIP148 than BIP341. I see your point regarding a small minority making broad changes to the protocol setting a bad precedence. The question is whether transactions are to be allowed to carry extra data with them. Not whether there are legitimate and illegitimate transactions. Super important distinction.
