The idea is that lawlessnes is when anything not demanded can be forbidden at a whim.

Where as a lawful state would hold that everything that is not forbidden is allowed.

Charles Murray has a great definition in his great book "By the People" where he says Law is indistinguishable from lawlessness when any of the following conditions are met:

-When the legal process is more costly than you can afford (lawfare comes to mind)

-When law is applied sufficiently arbitrarily and capriciously (think Pam bondis recent word on the Epstein files and then think about sending 600$ over venmo)

-When law is too complex (confusing and arbitray regulations destroy individual capital and businesses)

-laws that permit the state to take private property without compensation or to force the transfer of private property to other private individuals are indistinguishable from lawlessness. (This one is probably obvious)
